Terms and Conditions
Governing Law: Sultanate of Oman
These Terms and Conditions (“Terms”) govern the use of the Helpers mobile application (“App”) operated by [Your Company Name], a company registered in the Sultanate of Oman (“Company”, “we”, “us”, “our”).
By registering, accessing, or using the App, Users, Service Providers (companies and individual technicians), agree to be bound by these Terms.
1. Definitions
User/Customer: An individual using the App to request services.
Service Provider: A registered company or individual (e.g., cleaner, plumber, technician) offering services through the App.
Platform: The Helpers App, serving as an intermediary between Users and Service Providers.
2. Role of the Platform
1. Helpers is a digital marketplace that connects Users with independent Service Providers.
2. We do not provide cleaning, plumbing, electrical, or other services directly.
3. The contractual relationship for services is solely between the User and the Service Provider.
4. We do not guarantee the quality, safety, legality, or performance of services provided.
3. User Obligations
Users must provide accurate service requests, including scope of work and supporting images.
Users must make payments through the App’s approved payment channels.
Users are responsible for verifying the qualifications, licenses, and suitability of Service Providers.
4. Service Provider Obligations
Service Providers must provide accurate company or personal information and maintain valid commercial licenses/permits required under Omani law.
Service Providers are solely responsible for the quality, timeliness, safety, and legality of the services they provide.
Service Providers must comply with all applicable laws, labor regulations, and safety standards in Oman.
Any disputes between Service Provider and User regarding extra work, changes, or payment adjustments must be handled within the App approval process.
5. Payments
All payments must be made via the App.
Helpers may deduct a commission/transaction fee from payments made to Service Providers.
Refunds, if applicable, shall follow the dispute resolution process defined in the App.
6. Liability Disclaimer
1. The Company is not responsible for:
Any act, omission, negligence, or misconduct of Service Providers.
Any damages, losses, injuries, or accidents arising from services performed.
Any disputes between Users and Service Providers.
Verification of the background, skill, or legal compliance of Service Providers (though we may perform basic checks).
2. The Company’s role is strictly limited to facilitating connections and processing payments.
7. Approvals & Extra Work
Any additional services or costs beyond the original agreement must be approved by both User and Service Provider within the App.
The Company is not liable for any work or payment conducted outside the App.
8. Dispute Resolution
Disputes between Users and Service Providers should be resolved directly between them.
The Company may, at its discretion, assist in mediating disputes, but is not obligated to.
The Company’s decision in such mediation, if provided, shall be final.
9. Termination & Suspension
The Company reserves the right to suspend or terminate any User or Service Provider account for violation of these Terms or Omani law.
10. Indemnity
By using the App, Users and Service Providers agree to indemnify and hold harmless the Company, its directors, employees, and affiliates from any claims, damages, liabilities, or expenses arising from services provided or received through the App.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Sultanate of Oman. Any disputes shall be subject to the exclusive jurisdiction of the courts of Muscat, Oman.
